Agreement
These terms are an agreement between you and Duck Type LLC, a New Mexico limited liability company ("Duck Type", "we", "us"). They apply to ducktype.tech, to the websites of our apps, and to our apps: Yatzy Pop! and Cowboy for Herdr. By using any of them you agree to these terms. How we handle personal data is described in our privacy policy.
App licence
Our apps are licensed to you, not sold.
- From Apple's App Store: your use of the app is governed by Apple's Licensed Application End User License Agreement. These terms add to it where they do not conflict with it. Duck Type LLC, not Apple, is responsible for the app and its support.
- From Google Play: your use is governed by these terms together with the Google Play Terms of Service.
You may use the apps for personal, non-commercial purposes on devices you own or control. You may not copy, resell or redistribute them, or try to extract their source code except where the law expressly allows it.
Purchases and refunds
Where an app offers an in-app purchase, the price is shown before you buy and the payment is processed by Apple or Google. Refunds are handled by them under their own policies: for the App Store at reportaproblem.apple.com, and for Google Play through your Google Play order history. A purchase made with one Apple ID or Google account can be restored on other devices signed in to the same account.
Online features
Some features, such as online games in Yatzy Pop!, use our servers. When you use them:
- Pick a display name that is not offensive and does not impersonate anyone.
- Do not cheat, interfere with other players' games, or try to break, overload or gain unauthorised access to our servers.
- We may suspend or remove accounts that break these rules. You can delete your account from inside the app at any time.
We work to keep online features running but cannot promise they will always be available, and we may change or retire a feature. The parts of our apps that work offline keep working either way.
Third-party software
Cowboy for Herdr works with Herdr, a separate product that is not made by Duck Type LLC, running on computers you control. You are responsible for the machines, accounts and SSH access you connect to Cowboy, and for any input you choose to send to them through it. Sign-in with Apple or Google, and any VPN you use, are provided by those companies under their own terms.
Intellectual property
The apps, their names, icons, artwork and this website belong to Duck Type LLC or its licensors. Open-source components are used under their own licences. Nothing in these terms transfers ownership of any of it to you.
Disclaimer
We build our apps carefully, but they are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties beyond those stated in these terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow these exclusions, so they may not all apply to you.
Governing law
These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules. This does not take away any protection you have under the consumer laws of the country where you live.
Changes
We may update these terms. The new version will be posted on this page with a new effective date, and it applies from that date.
